Car accident kills 10-year-old in North Carolina

A tragic crash has claimed the life of a boy who was just about to turn 11, according to police in Asheboro. North Carolina authorities reported the horrific news of the car accident that killed a 10-year-old boy and injured two other children and an adult. Police say charges are pending against at least one of the drivers involved in the crash.

According to the accident report, around 7:43 the morning of Feb. 13, the boy was riding in a passenger vehicle with three other children and an adult driver. The children were carpooling to school when the driver made a turn onto an adjoining street. The driver reportedly did not see an SUV, which police say had the right of way, causing a collision in which the SUV struck the right rear side of the passenger car.

The impact forced the struck vehicle into another car that was stopped in a lane at the time. The drivers of all three vehicles as well as the remaining children were transported to local hospitals with injuries described as non life-threatening. It is unclear whether the 10-year-old was killed on the scene or was pronounced dead later on.

Depending upon the outcome of the police investigation, it seems possible the driver of the carpool vehicle could be cited with a traffic infraction for his or her role in the car accident. If this is the case, he or she could face criminal censure in a North Carolina court. In any event, the family of the deceased child, as well as the guardians of the other injured children and the injured adults, all have the right to file wrongful death and/or personal injury suits against the driver of the carpool vehicle. Any criminal charges filed do not directly influence the civil case, but they can be used to support a claim for damages.
